In 2023, there were many developments and controversies in the IP field. So, what was the top IP highlight for 2023? Well, according to our survey, the most controversial topic was the issue of IP ownership from AI-generated content. Artificial intelligence (AI) is the ability of machines or software to perform tasks that normally require human intelligence, such as learning, reasoning, and creativity. AI has been advancing rapidly in recent years and has been applied to various domains, such as healthcare, education, entertainment, and of course, IP. AI can generate content that may qualify as intellectual property, such as music, art, literature, or even inventions. But who owns the IP rights to these AI-generated creations? Is it the human who designed, trained, or operated the AI system? Is it the AI system itself? Or is it no one at all? Adire and Aso Oke are traditional fabrics that have been produced and worn by the Yoruba people of Nigeria for centuries. Adire is a tie-dyed cloth that uses indigo dye and resist-dyeing techniques to create various patterns and motifs. Aso oke is a hand-woven cloth that is used to make men's gowns, hats, women's wrappers, and head ties. Both fabrics are part of the rich cultural heritage and identity of the Yoruba people, and they reflect their history, values, and aesthetics. However, these fabrics are now facing a serious threat from Chinese counterfeiters, who have been copying their designs and producing cheap imitations that are smuggled into Nigeria. The case of Abdulmumineen Onilemarun v Coca-Cola Nigeria Plc and the Nigerian Bottling Company is a recent example of a successful lawsuit against a multinational corporation for copyright infringement in Nigeria. The Authors Guild of America strike in 2023 is an ongoing labour dispute between the Writers Guild of America (WGA), a labour union that represents 11,500 authors, and the Alliance of Motion Picture and Television Producers (AMPTP), which started at 12:01 a.m. PDT on May 2, 2023. The primary points of contention in the strike are the residuals from streaming media, the size and length of authors' rooms, and the use of artificial intelligence in the writing process. The WGA asserts that AMPTP's portion of these residuals has significantly reduced the average wages of writers compared to a decade ago. Additionally, writers prefer that artificial intelligence, such as ChatGPT, be utilized to support rather than replace them in script development or research. Millicent Umoru LL.B, B.L, ACIS (In-view) tagged me to a link and asked for my view on a matter that was viral on Twitter with the hashtag #justiceforspongbob. I read through the post and discovered that a fan of #spongebob had recreated a movie called SpongeBob SquarePants: Rehydrated and it was taken down from YouTube for Copyright Violations after a complaint was field by #ParamountPictures hence the outrage. My initial thoughts were that maybe PencilWorkshop and his team were guilty of it but as I began my research on the case I got to learn a lot about the intellectual property rights in animations, a guideline for fan films, more about how YouTube takedown notice works, how best to classify the act etc Today's #IPSERIES is a commentary on the #justiceforspongebob case with a brief comparison of the US and Nigerian copyright systems.
